AJ Design have successfully appealed a refused planning application in mid Devon. The proposed works were the partial demolition of a boundary wall to allow vehicle access onto a new parking space in our client’s front garden. The council refused the works because they felt the proposals “would not retain the currently afforded sense of enclosure in the area, which would result in unacceptable harm to the local setting of the Conservation Area”
There was also a lot of local objection to the proposed works.
On our client’s instruction we prepared a detail statement explaining why we believed the council were wrong to refuse the application and lodged an appeal against the council’s refusal notice. The Planning Inspector appointed by the Secretary of State for Communities and Local Government has allowed our appeal despite the objections raised by the council and local residents.
